Terms of Service

The terms that govern your use of tucsonfoodie.com, the Tucson Foodie app, and the Insiders Club membership, including our SMS program terms.

These Terms of Service ("Terms") govern your use of tucsonfoodie.com, the Tucson Foodie mobile app, and related services (together, the "Services"), operated by Tucson Foodie, LLC ("Tucson Foodie," "we," "us"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

Tucson Foodie is a local food media publication and community. The Services include editorial content (news, guides, events), community features (accounts, saved lists, dish photos, ratings), and a paid membership program (the "Insiders Club").

2. Accounts

You may need an account to use certain features. You are responsible for the accuracy of the information you provide and for all activity under your account. You must be at least 13 years old to create an account. We may suspend or terminate accounts that violate these Terms.

3. Memberships and payments

Paid memberships are billed through our payment processor, Stripe, on the schedule presented at signup. Memberships renew automatically until canceled. You can cancel at any time, effective at the end of the current billing period. Member perks (such as vouchers) are offered by Tucson Foodie and participating businesses, have no cash value, may change or end at any time, and are subject to any terms shown with the specific perk. Refunds are handled on a case-by-case basis; contact us at info@tucsonfoodie.com.

4. Your content

Features of the Services let you submit content — for example, dish photos, names, and descriptions ("User Content"). You retain ownership of your User Content. By submitting it, you grant Tucson Foodie a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content in connection with operating and promoting the Services (for example, showing your dish photo in the app, on the website, or in our social channels, with credit where we display it).

You agree not to submit content that is unlawful, infringing, deceptive, hateful, or that you do not have the right to share. We may remove User Content at our discretion.

5. Our content

The Services and their contents — articles, guides, photographs, graphics, logos, and software — are owned by Tucson Foodie or its licensors and are protected by copyright and other laws. You may share links to our content and use it for personal, non-commercial purposes. You may not republish, scrape, or commercially exploit our content without written permission.

6. Acceptable use

You agree not to misuse the Services, including by: attempting to access accounts or systems without authorization; interfering with the operation of the Services; scraping or bulk-collecting content or data; impersonating others; or using the Services to send spam or unlawful communications.

7. Events and third-party businesses

The Services describe restaurants, events, and other third-party businesses. We work hard for accuracy, but hours, menus, prices, and availability change; we are not responsible for the acts, omissions, products, or services of third-party businesses. Tickets or purchases from third parties are governed by those parties' terms.

8. SMS / text messaging program

If you opt in to receive text messages from Tucson Foodie, the following terms apply.

Program description. Tucson Foodie may send informational text messages in response to your requests, including prize confirmations from event interactions, app download instructions, account-related notifications, assistance and support messages, and event reminders or updates. Messages are only sent in response to your voluntary inquiries or opt-in. Message frequency varies.

Consent. By providing your mobile phone number and sending a text to the Tucson Foodie SMS number, you expressly consent to receive automated and manually sent text messages from Tucson Foodie or its service providers. Users typically opt in by texting the Tucson Foodie phone number after seeing signage at a Tucson Foodie event or promotion, or by submitting their phone number through a form on tucsonfoodie.com related to events, prizes, account setup, or program support. You confirm that you are the owner or authorized user of the mobile number you provided. Consent to receive text messages is not a condition of purchasing any goods or services.

Message & data rates may apply. Your wireless carrier is responsible for any charges related to SMS messaging.

Opt-out. You may opt out at any time by replying STOP to any message from Tucson Foodie. After you send STOP, we will send a one-time confirmation message and will retain your information in our suppression list to ensure you do not receive further messages unless you opt back in.

Help. For help or information about the program, reply HELP to any text message or email us at info@tucsonfoodie.com.

No marketing unless opted in. You will not receive marketing SMS messages from Tucson Foodie unless you explicitly opt in to receive those in addition to event or account messages.

Privacy. Your mobile phone number will be handled in accordance with our Privacy Policy. We do not share your phone number with third parties for marketing purposes without your consent.

Timing. Messages may be sent to you at any time based on your requests. You agree that Tucson Foodie is not responsible for message delivery delays.

9. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the fullest extent permitted by law, Tucson Foodie will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of $100 or the amount you paid us in the twelve months before the claim arose.

11. Indemnification

You agree to indemnify and hold harmless Tucson Foodie and its officers, employees, and agents from claims arising out of your User Content, your use of the Services, or your violation of these Terms.

12. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Pima County, Arizona.

13. Changes to these Terms

We may modify these Terms at any time. Changes will be posted at this URL and are effective when posted. Your continued use of the Services after changes are posted constitutes acceptance.

@Casaveratucson opens Aug. 12 at 7265 N. La Cholla Blvd., bringing regional Mexican cuisine to the former Tamarind space.

The 7,000-square-foot restaurant seats 200 guests with a large patio, and the design draws inspiration from a warm, old-world hacienda. The family behind Casa Vera is also known locally for Guadalajara Original Grill.

Casa Vera will be open daily from 3-9 p.m. Reservations are available through @opentable or by emailing reservations@casaveratucson.com.
